The US Supreme Court granted a stay in the case of Troy Davis while they consider his appeal.

All that’s fair is that they hold a trial & listen to what the 7 of the 9 witnesses who recanted their statements said.

One of the ones that didn’t is the other suspect (Sylvester Coles).

And there’s been new evidence in the case, including 3 new witnesses who say that Coles confessed to them (or in 1 case, was bragging) about killing the officer.

Anyway, all I’m hoping for now is a fair trial so that I can believe in my Justice System.

JACKSON, GA (WTOC) – The US Supreme Court has granted a week-long stay of execution for Troy Anthony Davis just under two hours before he was scheduled to be put to death.

Davis is in the Georgia Diagnostic and Classification Prison in Jackson, Georgia where family and supporters gathered to protest the scheduled execution.

Davis’ sister Martina Correia knows it’s a long road, but says they’re not giving up.

“We still have to get the Supreme Court to hear the case and hear the arguments but I know if they will take this case that one day my brother will be vindicated and walk free,” she said. “I just want to pray for the victim’s family. I know that they’re hurting and everything but Troy is not guilty of this crime. We dishonor Officer MacPhail by killing Troy and I think that the Supreme Court showed us today there’s something going on when we’re rushing to execute somebody before they even have an opportunity to review the case.”

Activist reverend Al Sharpton led Davis’ supporters in prayer after they found out about the stay.

Members of MacPhail’s family also issued a statement after the stay was issued.

The US Supreme Court will review Davis’ request for an appeal on September 29.

I feel sick to my stomach. I opened up my email today & saw that Troy Davis’s execution has been scheduled for Tues evening @ 7 pm!! Please go to Amnesty International’s site & click on the link to sign the letter to Georgia’s Board of Pardon & Parole.

I can’t believe we are about to execute (EXECUTE!) a man that may be innocent. There has been SO MUCH doubt in his trial. I’ve posted about him since June of 2007, & I thought for sure the court would be fair. But alas….

Let’s go over the facts:

  • There was no physical evidence against Troy Davis.
  • The weapon used was never found.
  • The case against him consisted entirely of witness testimony.
  • All but two of the state’s non-police witnesses have recanted or contradicted their testimony.
  • Many of these witnesses have stated that they were pressured or coerced by the police.
  • One of the witnesses who has not recanted is Sylvester Coles, the principle alternative suspect.
  • Nine individuals have signed affadavits implicating Sylvester Coles.
  • Troy Davis has never had a hearing in federal court on the reliability of the witness testimony used against him.

Ok, so remember the ppl who recanted their stories? Well, Abolish the Death Penalty has what they specifically said about it:

Darrell Collins:[The police] were telling me that I was an accessory to murder and that I would … go to jail for a long time and I would be lucky if I ever got out, especially because a police officer got killed…I was only sixteen and was so scared of going to jail.

Antoine Williams:After the officers talked to me, they gave me a statement and told me to sign it. I signed it. I did not read it because I cannot read … I was totally unsure whether he was the person who shot the officer. I felt pressured to point at him … I have no idea what the person who shot the officer looks like.

Jeffrey Sapp:The police came and talked to me and put a lot of pressure on me…. They wanted me to tell them that Troy confessed to me about killing that officer. The thing is, Troy never told me anything about it. I got tired of them harassing me …. I told them that Troy did it, but it wasn’t true.

Daniel Kinsman:[T]here was and is no doubt in my mind that the person who shot the officer had the gun in and was shooting with his left hand.” Davis is right-handed.

Shirley Riley:People on the streets were talking about Sylvester Coles being involved with killing the police officer, so one day I asked him if he was involved …. Sylvester told me he did shoot the officer.

Joseph Washington:I am positive that it was Red [Coles] who shot the police officer… [He] was wearing a white shirt…I had no idea that the shirt…was important because no one ever asked me…I would have testified to this but I was not asked by the state or by Troy’s lawyers.

When you issued this decision, you stated that the Board “will not allow an execution to proceed in this State unless and until its members are convinced that there is no doubt as to the guilt of the accused.” In March, the Georgia Supreme Court denied Troy Davis a hearing, so doubts of his guilt will always remain. In their dissenting opinion, three members of the Georgia Supreme Court, including the Chief Justice, wrote of their doubts about Troy Davis’ guilt.

Please clarify your reasons for denying clemency, and how you have dispelled all doubt.

This case has generated widespread attention, which reflects serious concerns in Georgia and throughout the United States about the potential for executing an innocent man. Nothing can undermine public faith in a criminal justice system faster than an execution when serious doubts about guilt have not been resolved.

The power of clemency exists as a safety net to prevent such an irreversible error and preserve public confidence in the state’s capacity for justice.

The integrity of justice in Georgia is at stake in this case. I urge you to clarify your reasons for denying clemency, to reconsider your decision, and to stop the execution of Troy Davis.

I was just fascinated w/ Harvey Milk & I still haven’t seen that documentary that I wanted to.

Well, I just found out that they’re doing another movie about Harvey Milk & Sean Penn’s gonna play him. Oh, oh , OH, & there’s MORE! Gus Van Sant is directing! My Own Private Idaho was one of my fave movies! If you love Shakespeare, you have to see it!

I’m not a huge Sean Penn fan, but I am a big Harvey Milk fan & a big Gus Van Sant. I’m definitely not going to miss this one. Hopefully, I’ll have seen that 1984 doc by then too.
